Amazon sued for misleading pricing › ifun.de

Online retailer Amazon is facing a new class action lawsuit accusing the company of deception in the pricing of its Fire TVs. The lawsuit was filed in the US state of Washington and accuses Amazon of artificially high list prices for its Fire TVs in order to make discounts appear larger than they actually were.

Misleading pricing

According to the lawsuit, Amazon allegedly used “false list prices” for its Fire TVs to get customers to buy them. Some of these prices had not been in use for a year or more, causing customers to spend more than they would have without the biggest discounts.

In addition, important information, such as the exact duration of the discount campaigns, was not adequately disclosed. The plaintiffs see this as a violation of local consumer protection laws that prohibit unfair business practices.

Lawsuits and similar cases

The plaintiff in the case is David Ramirez, who is seeking not only damages but also a court order preventing Amazon from continuing this practice.

The lawsuit also relates to a similar case from California in 2021. At that time, Amazon was also accused of using misleading list prices to create the impression that products had previously been offered by another seller at a higher price.

In some cases, Amazon failed to adequately disclose that these comparison prices did not necessarily reflect the current market or retail price. This is also part of the current allegations in the lawsuit.

In the 2021 case, Amazon was prohibited from using false advertising or misleading list prices. At the time, the company agreed to a settlement and paid about two million US dollars in fines and damages.

Amazon has not yet commented publicly on the current allegations.
