India’s Supreme Court on Tuesday directed the Central Bureau of Investigation (CBI) to submit a status report on the ongoing investigation into the rape and murder of a junior doctor at Kolkata’s RG Kar Medical College and Hospital. The court’s intervention follows disturbing revelations in the probe into financial irregularities at the hospital and concerns about overall security measures in West Bengal’s healthcare facilities. The court also directed Wikipedia to remove the victim’s name and questioned the progress of the investigation.

Very disturbing details in CBI status report: SC

During the hearing, Chief Justice DY Chandrachud commented on the latest findings of the CBI and said that the status report submitted to the court contained “very disturbing” details. The Chief Justice stressed the seriousness of the matter and added that disclosing the details of the investigation at this stage would “jeopardise the course of the investigation” and urged the public to remain patient as the investigation continues.

CBI investigation delayed by “five days”

The CBI said there was a delay due to a “five-day gap” between the crime and the start of the investigation, which hampered progress. Despite this, the agency has made several key arrests, including the hospital’s director and the local Station House Officer (SHO). More arrests and findings are expected as the investigation continues.

Concerns about the autopsy procedures

One area identified as problematic by the CBI is whether statutory post-mortem procedures were properly followed. Investigators are also looking into whether there was any tampering at the crime scene or attempts to destroy key evidence. Chief Justice Chandrachud confirmed that the victim’s father had provided clues that could help in the investigation and the CBI was encouraged to take these clues into account.

Hiring of contract staff

In addition to the criminal investigation, the Supreme Court also raised questions about the security measures in place for doctors and staff in hospitals in West Bengal. The court criticised the West Bengal government for its decision to hire contractual staff for hospital security and questioned the effectiveness of such measures, questioning whether this approach adequately protects healthcare workers.

Wikipedia was ordered to remove the victim’s name

Furthermore, the court directed Wikipedia to remove the victim’s name from its platform to protect her privacy. The order came after the top court was informed that the website had used the aspiring doctor’s name and created an image of the victim even though the investigation was ongoing.

Discontinuation of the “Rattierer Saathi” programme

The Supreme Court had earlier raised concerns over the scheme, which is part of the state’s ‘Rattierer Saathi’ scheme. The state government was asked to withdraw its notification limiting duty hours for women doctors under the scheme, which mandates avoiding night shifts. The court warned that such measures could hamper the careers of women doctors and create unequal working conditions in hospitals. The West Bengal government, which appeared before the court, has indicated that it will withdraw its controversial notification.

Investigations are ongoing

While the investigation continues, the Supreme Court is cautious not to reveal too much information at this stage, aware that premature disclosure could hamper the discovery of crucial evidence. Chief Justice Chandrachud reiterated that the court’s primary concern was to ensure that the “absolute truth” comes out.

The CBI has been asked to provide an updated status report as the investigation progresses and the court will closely monitor further developments in the case. Meanwhile, the West Bengal government’s policies regarding hospital staff and security will continue to be closely examined as the case progresses.

The investigation, which was initiated on its own initiative (on the request of the court), is aimed at clarifying the circumstances of the rape and murder of the junior doctor. In addition to the criminal investigation, the CBI is also looking into possible financial irregularities at the hospital.
