Former ASG writes to CJI suggesting introduction of Sexual Assault Evidence Kits

New Delhi [India]September 3 (ANI): Referring to the Kolkata rape and murder case, former Deputy Attorney General Pinky Anand recently wrote to Chief Justice DY Chandrachud. In her letter, she suggested introduction of Sexual Assault Evidence Kits and appointment of Sexual Assault Nurse Examiners to enable prompt action in cases of crimes against women.

In her letter, Anand made several suggestions to strengthen the legal system in dealing with crimes against women, especially rape. Her recommendations aim to improve the effectiveness of the legal system in dealing with such cases.

Their recommendations include the use of Sexual Assault Evidence Collection (SAEC) kits. These kits are designed for the systematic collection of forensic evidence from victims, including swabs, bags and forms for hair, bodily fluids and other evidence needed for forensic analysis.

She also suggested Sexual Assault Nurse Examiner (SANE): SANE nurses are specially trained to collect evidence, provide immediate medical and psychological support, conduct forensic examinations and testify in court as expert witnesses. Their training includes gender sensitization and awareness of unconscious bias.

Anand also suggested setting up crisis centres for victims of sexual violence in cities and specific localities. These centres would provide comprehensive support to victims, including medical, psychological, legal and financial assistance, and act as a one-stop shop for holistic care. These recommendations aim to improve efficiency and support systems in dealing with sexual violence cases, the letter said.

The above recommendations are inspired by successful and proven strategies in other legal systems and are intended to complement the new criminal justice system. They aim to address the serious safety and dignity issues faced by women in the workplace and in public, the letter says.

The Supreme Court, as the guardian of constitutional rights and values, has taken cognizance of this case on its own initiative and stressed the urgent need for laws and policies that address the gravity of these issues. It is critical that our legal and institutional frameworks evolve to reflect the magnitude of the problem and ensure that such tragedies are not repeated and that justice is fully served.

Anand explained that she recently wrote the letter as a woman, a committed citizen and a lawyer with 43 years of professional experience, including as an Assistant Attorney General and with extensive experience in criminal justice practice. (ANI)
