Decision of the Arbitration Tribunal of SIX Group AG accepted
In a decision dated March 31, 2023, the Sanctions Commission of SIX Group AG found that poenina holding ag had intentionally violated the rules on ad hoc publicity by classifying the criminal conviction of its Board of Directors Delegate at the time as irrelevant for the share price and therefore publishing this information late. The Sanctions Commission imposed a fine of CHF 150,000 on Burkhalter Holding AG, as the legal successor to poenina holding ag. Burkhalter Holding AG filed an appeal against the decision with the Arbitration Tribunal of SIX Group AG on June 14, 2023. Burkhalter Holding AG wanted to clarify, among other things, whether it, as the legal successor to poenina holding ag, was responsible for the violation of the listing regulations by poenina holding ag. It also questioned the appropriateness of the amount of the fine. The appeal was dismissed by the Arbitration Tribunal of SIX Group AG. Burkhalter Holding AG, which became the legal successor following the merger of poenina holding ag at the end of June 2022, accepts the decision of the arbitration tribunal of SIX Group AG. This decision has no significant impact on the financial results of the Burkhalter Group.
