Court learns that mother falsified DNA test result to prevent father from seeing her newborn

Mr Fitton took legal action to gain access to his children and to have his name added to his youngest daughter’s birth certificate.

Two months later, Ms Saville reportedly sent Mr Fitton’s lawyers the results of a DNA test, which showed that her then-boyfriend Mr Mellows was the baby’s father.

In July 2022, the Family Court ordered another DNA test, which established Mr Fitton as the father.

At a hearing at the time, her lawyer said she “panicked” and made an “ill-informed decision” when she initially submitted the false DNA test results.

The Crown Court heard that Ms Saville then went to the registry office to add Mr Mellows’ name to the birth certificate, which they both signed.

“He was not the father,” Mr Tucker told the court. “He must have known that and Georgina Saville certainly knew that too.”

He added: “Knowing that Kyle was the father, she made a false statement to the Birth and Death Authority, knowing full well that she could actually prove [Mr Mellows] had parental responsibility, while [Mr Fitton] wouldn’t.”

When she was arrested, Ms Saville told police she had submitted a “fabricated” DNA test to “get rid of” Mr Fitton.

Mr Tucker added: “It is clear that she knew full well that Kyle Fitton was in fact the father. She produced a document which she knew misrepresented [her child]’s paternity.

“She was trying to mislead him and his lawyer, and this test result, if taken at face value, might have dissuaded him from pursuing the case further.

“We say this was a malicious and calculated attempt to derail his case through dishonest means. What she did was misleading because she made a positive claim that Danny was the father.”

Ms Saville admits to falsifying the DNA test and maintains that she genuinely believed that Mr Mellows could be the child’s father.
